1. Agreement to Terms

Welcome to TravelTinder ("we," "us," "our," or "Company"). These Terms of Service ("Terms") govern your access to and use of the TravelTinder mobile application (the "App"), including any content, functionality, and services offered on or through the App.

By creating an account, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree to these Terms, you must not access or use the App.

IMPORTANT: These Terms contain an arbitration clause and class action waiver in Section 16, which affects your rights to resolve disputes. Please read it carefully.


2. Eligibility

2.1 Age Requirements

You must be at least 13 years old to use the App. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you represent that you have obtained consent from your parent or legal guardian to use the App and that they have read and agreed to these Terms on your behalf.

2.2 Geographic Restrictions

The App is intended for users worldwide, but functionality may vary by location. Some features may be unavailable in certain jurisdictions due to local laws or service provider limitations.

2.3 Prohibited Users

You may not access or use the App if:

  • You have been previously banned or suspended from the App
  • You are prohibited by law from using such services
  • Your account has been terminated for violation of these Terms

3. Account Registration and Security

3.1 Account Creation

To access most features of the App, you must create an account using one of the following authentication methods:

  • Google Sign-In (OAuth 2.0)
  • Apple Sign-In

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Immediately notifying us of any unauthorized access or security breach

We are not liable for any loss or damage arising from your failure to protect your account credentials.

3.3 One Account Per User

You may only create and maintain one account. Creating multiple accounts to circumvent restrictions, obtain additional free credits, or otherwise abuse the service is strictly prohibited and may result in termination of all associated accounts.


4. Description of Service

4.1 Service Overview

Triv is an AI-powered travel planning application that enables users to:

  • Discover attractions, restaurants, and experiences through a swipe-based interface
  • Generate personalized travel itineraries using artificial intelligence
  • Customize trips based on preferences including budget, pace, interests, and travel dates
  • View and manage trip plans with map integration and drag-and-drop editing

4.2 Credit System

The App operates on a credit-based system:

  • New Users: Receive 1 free credit upon account creation
  • Trip Generation: Each AI-generated itinerary costs 1 credit
  • Acquiring Credits: Users can purchase credits through subscriptions or one-time purchases

4.3 Service Modifications

We reserve the right to:

  • Modify, suspend, or discontinue any part of the App at any time
  • Change the number of credits required for services
  • Add, remove, or modify features and functionality
  • Impose limits on certain features or restrict access to parts of the App

We will make reasonable efforts to notify users of material changes, but are not obligated to do so.


5. Subscriptions and Payments

5.1 Subscription Plans

We offer the following subscription plans, which automatically renew unless cancelled:

  • Explorer Plan: $2.99/week, provides 4 credits per week
  • Voyager Plan: $5.99/week, provides 12 credits per week
  • Globetrotter Plan: $9.99/week, provides 25 credits per week

5.2 One-Time Purchases

  • Day Tripper: $3.99 one-time purchase, provides 2 credits (non-expiring)

5.3 Payment Processing

All payments are processed through the Apple App Store using Apple's In-App Purchase system and managed by RevenueCat. By making a purchase, you agree to:

  • Apple's App Store Terms and Conditions
  • RevenueCat's Terms of Service
  • Provide accurate and complete payment information

We do not directly process or store your payment information.

5.4 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription price. To cancel, you must disable auto-renewal in your Apple App Store account settings at least 24 hours before the end of the current billing period.

5.5 Price Changes

We reserve the right to change subscription prices at any time. Price changes will:

  • Not affect current subscribers until their next renewal period
  • Be communicated to users with at least 30 days' advance notice
  • Give users the opportunity to cancel before the new price takes effect

5.6 Refund Policy

All sales are final. Refunds are handled exclusively through Apple's App Store refund policies. To request a refund:

  1. Visit https://reportaproblem.apple.com
  2. Sign in with your Apple ID
  3. Locate your Triv purchase
  4. Request a refund

We reserve the right to deduct corresponding credits from your account if a refund is granted.

5.7 Credit Balance

  • Credits do not expire unless your account is terminated
  • Credits are non-transferable and have no cash value
  • Credits cannot be redeemed for cash or exchanged for value outside the App
  • Unused credits are forfeited upon account deletion or termination

6. User Conduct and Prohibited Activities

6.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

(a) Violate Laws

  • Violate any applicable federal, state, local, or international law or regulation
  • Engage in any activity that promotes illegal activities

(b) Unauthorized Access

  • Attempt to gain unauthorized access to any portion of the App, other users' accounts, or computer systems or networks connected to the App
  • Use any automated means (bots, scrapers, crawlers) to access the App without our express written permission
  • Probe, scan, or test the vulnerability of any system or network

(c) Abuse or Manipulation

  • Create multiple accounts to obtain additional free credits or circumvent restrictions
  • Manipulate the credit system, payment system, or any App functionality
  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App

(d) Interference

  • Interfere with or disrupt the integrity or performance of the App or its servers
  • Introduce viruses, malware, or other malicious code
  • Take any action that imposes an unreasonable load on our infrastructure

(e) Impersonation and Misrepresentation

  • Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
  • Use another user's account without permission

(f) Data Collection

  • Collect or harvest any personally identifiable information from the App or other users
  • Use data mining, robots, or similar data gathering methods

6.2 Enforcement

We reserve the right to:

  • Remove or refuse to post any content
  • Suspend or terminate your account
  • Pursue legal action for violations
  • Cooperate with law enforcement authorities

Violations may result in immediate termination without refund of any unused credits or subscription time.


7. Intellectual Property Rights

7.1 Our Ownership

The App and its entire contents, features, and functionality (including but not limited to all information, software, code, text, displays, graphics, photographs, video, audio, design, presentation, selection, and arrangement) are owned by Triv, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

  • Download and install the App on devices you own or control
  • Access and use the App solely for personal, non-commercial purposes

7.3 Restrictions

You may not:

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or software obtained from the App
  • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
  • Use the App's name, trademarks, or branding without our prior written consent

7.4 Feedback

If you provide us with any feedback, suggestions, or ideas about the App ("Feedback"), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate such Feedback into our products and services without any obligation to you.


8. User-Generated Content

8.1 Your Content

You retain ownership of any content you create through the App, including:

  • Trip preferences and customization
  • Swipe history and place selections
  • Edits to generated itineraries

However, by using the App, you grant us a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, and transferable license to use, reproduce, modify, and process your content solely to:

  • Provide and improve the service
  • Generate AI-powered itineraries
  • Optimize recommendations and functionality

8.2 Privacy

Your trip data is private and not shared with other users. See our Privacy Policy for details on how we collect, use, and protect your information.

8.3 No Obligation to Monitor

We have no obligation to monitor user content or activity but reserve the right to do so for:

  • Compliance with legal obligations
  • Enforcing these Terms
  • Protecting the rights, property, or safety of Triv, users, or the public

9. Third-Party Services and Content

9.1 Third-Party Services

The App integrates with third-party services including:

  • Google Places API: For place information, photos, and location data
  • Google Gemini AI (via OpenRouter): For AI-powered itinerary generation
  • Firebase/Google Cloud: For authentication and data storage
  • Apple App Store: For payment processing
  • RevenueCat: For subscription management

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services, their content, or their practices.

9.2 Place Information

Place information (attractions, restaurants, hotels) is provided by Google Places API and other data sources. We do not:

  • Guarantee the accuracy, completeness, or timeliness of place information
  • Endorse or recommend any specific establishments
  • Control or verify hours of operation, closures, or availability
  • Warrant that places will meet your expectations

You are responsible for verifying all details before visiting any location.

9.3 AI-Generated Content

Itineraries are generated using artificial intelligence (Google Gemini 2.5 Flash). While we strive for quality:

  • AI-generated content may contain errors, inaccuracies, or inappropriate suggestions
  • We do not guarantee the suitability of any AI-generated itinerary
  • You are responsible for reviewing and verifying all travel plans
  • We are not liable for any issues arising from following AI-generated recommendations

10. Disclaimers and Limitations of Liability

10.1 "AS IS" and "AS AVAILABLE" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

  • The App will function uninterrupted, secure, or error-free
  • Defects will be corrected
  • The App or servers are free of viruses or harmful components
  • Results from using the App will be accurate or reliable

10.2 Travel Disclaimers

WE ARE NOT A TRAVEL AGENCY, TOUR OPERATOR, OR BOOKING SERVICE. We do not:

  • Make reservations or bookings on your behalf
  • Guarantee availability of any attractions, accommodations, or services
  • Provide travel insurance or emergency assistance
  • Assume responsibility for your travel safety or experiences

YOU ARE SOLELY RESPONSIBLE FOR:

  • Making your own travel arrangements and bookings
  • Verifying visa requirements, travel advisories, and safety conditions
  • Obtaining appropriate travel insurance
  • Ensuring you have valid travel documents
  • Your personal safety during travel

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Triv, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:

  1. Indirect Damages: Any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

    • Lost profits, revenue, or data
    • Loss of goodwill or reputation
    • Cost of substitute services
    • Personal injury or property damage
    • Travel disruptions, cancellations, or expenses
  2. Direct Damages Cap: Any direct damages exceeding the greater of (a) $100 or (b) the amount you paid us in the 12 months preceding the claim

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we were advised of the possibility of such damages.

10.4 No Liability for Third-Party Actions

We are not liable for:

  • Actions or omissions of third-party service providers (hotels, airlines, attractions, restaurants)
  • Inaccurate or outdated information from third-party data sources
  • Third-party payment processing issues
  • Performance or availability of third-party APIs and services

10.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, pandemics, or acts of God
  • War, terrorism, civil unrest, or government actions
  • Internet or telecommunications failures
  • Third-party service outages
  • Labor disputes or shortages

11. Indemnification

You agree to indemnify, defend, and hold harmless Triv, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  1. Your violation of these Terms or applicable laws
  2. Your use or misuse of the App
  3. Your violation of any third-party rights, including intellectual property rights
  4. Any content you submit or transmit through the App
  5. Your travel activities or any injuries, losses, or damages resulting from travel
  6. Any disputes between you and third-party service providers

This indemnification obligation survives termination of these Terms and your use of the App.


12. Privacy and Data Protection

12.1 Privacy Policy

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the App, you consent to:

  • Collection and use of information as described in the Privacy Policy
  • Transfer of data to the United States and other jurisdictions where our service providers operate
  • Use of cookies and similar tracking technologies

12.2 Data Processing for AI

By using the itinerary generation feature, you specifically consent to:

  • Processing your preferences and swipe data by Google Gemini AI (via OpenRouter)
  • Transfer of your trip parameters to third-party AI services
  • Use of AI models that may process data outside the United States

12.3 Data Retention

We retain your personal data as long as:

  • Your account remains active
  • Necessary to provide services
  • Required by law or for legitimate business purposes

Upon account deletion, we will delete or anonymize your data within 30 days, except as required by law.


13. Term and Termination

13.1 Term

These Terms commence when you first access or use the App and continue until terminated by either you or us.

13.2 Termination by You

You may terminate these Terms at any time by:

  • Deleting your account through the App settings
  • Uninstalling the App from all your devices
  • Ceasing all use of the App

Account deletion is permanent and irreversible. All your data, trips, and unused credits will be forfeited.

13.3 Termination by Us

We may terminate or suspend your access immediately, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Requests by law enforcement or government agencies
  • Unexpected technical or security issues
  • Discontinuation or material modification of the App
  • Extended periods of inactivity

13.4 Effect of Termination

Upon termination:

  • Your right to use the App ceases immediately
  • All licenses granted in these Terms terminate
  • You forfeit all unused credits (no refunds except as required by law)
  • We may delete your account data after 30 days
  • Sections that by their nature should survive termination will survive, including Sections 7, 10, 11, 14, 16, and 18

13.5 No Refunds on Termination

If we terminate your account for cause, you forfeit all credits and subscription time without refund. If you voluntarily terminate, refunds are subject to our refund policy (Section 5.6).


14. International Use and Export Controls

14.1 Jurisdiction

The App is controlled and operated from the United States. We make no representation that the App is appropriate or available for use in other locations. If you access the App from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

14.2 Export Restrictions

You represent and warrant that:

  • You are not located in a country subject to U.S. government embargo or designated as a "terrorist supporting" country
  • You are not listed on any U.S. government list of prohibited or restricted parties

You may not use the App in violation of any U.S. export laws or regulations.


15. Copyright and DMCA Policy

15.1 Copyright Infringement

We respect intellectual property rights. If you believe material in the App infringes your copyright, please provide our designated Copyright Agent with:

  1. Electronic or physical signature of the copyright owner or authorized representative
  2. Description of the copyrighted work claimed to be infringed
  3. Description of where the allegedly infringing material is located in the App
  4. Your contact information (address, telephone number, email)
  5. Statement that you have a good faith belief the use is not authorized
  6. Statement that the notification is accurate and, under penalty of perjury, you are authorized to act on behalf of the copyright owner

15.2 Counter-Notification

If you believe material was removed in error, you may submit a counter-notification with:

  1. Your physical or electronic signature
  2. Identification of the removed material and its prior location
  3. Statement under penalty of perjury that the material was removed by mistake or misidentification
  4. Your contact information and consent to jurisdiction

16. Dispute Resolution and Arbitration

16.1 Informal Resolution

Before filing a claim, you agree to contact us at support@hiretech.agency and attempt to resolve the dispute informally for at least 30 days. Include your name, contact information, description of the dispute, and relief sought.

16.2 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.

If we cannot resolve a dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the App will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

Exceptions: Either party may bring claims in small claims court if they qualify. Additionally, either party may seek injunctive relief in court for intellectual property infringement or unauthorized access.

16.3 Arbitration Procedures

  • Location: Arbitration will be conducted in the county where you reside or another mutually agreed location
  • Rules: AAA Consumer Arbitration Rules apply (available at www.adr.org)
  • Arbitrator: One arbitrator selected per AAA rules
  • Costs: Each party bears its own costs unless the arbitrator awards fees to the prevailing party
  • Discovery: Limited discovery as determined by the arbitrator
  • Decision: The arbitrator's decision is final and binding, subject to limited judicial review

16.4 CLASS ACTION WAIVER

YOU AND Triv AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

Unless both parties agree otherwise in writing:

  • No arbitration or claim may be joined with another
  • No arbitrator may consolidate proceedings
  • No arbitrator may preside over any consolidated, representative, or class proceeding

If this class action waiver is found unenforceable, the entire arbitration agreement is void.

16.5 Opt-Out Right

You may opt out of this arbitration agreement by sending written notice to support@hiretech.agency within 30 days of first accepting these Terms. The notice must include your name, address, and a clear statement that you wish to opt out. If you opt out, all other terms still apply, but disputes will be resolved in court under Section 16.6.

16.6 Governing Law and Venue (If Arbitration Does Not Apply)

If arbitration does not apply (e.g., you opted out or the arbitration clause is unenforceable), these Terms are governed by the laws of the State of California without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.

16.7 Time Limit for Claims

You must bring any claim within one year after the claim arises, or it is permanently barred.


17. Miscellaneous Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms you agree to when using specific features, constitute the entire agreement between you and Triv regarding the App and supersede all prior agreements.

17.2 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by us.

17.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section is void.

17.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights except as expressly stated.

17.6 Force Majeure

We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

17.7 Relationship of the Parties

You and Triv are independent contractors. These Terms do not create a partnership, franchise, joint venture, agency, fiduciary, or employment relationship.

17.8 Survival

All provisions that by their nature should survive termination will survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, limitations of liability, and dispute resolution.

19. Changes to Terms

19.1 Right to Modify

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

  • Posting the updated Terms in the App with a new "Last Updated" date
  • Sending an email to your registered email address (if available)
  • Displaying an in-app notification upon your next login

19.2 Acceptance of Changes

Changes are effective immediately upon posting for new users. For existing users, changes become effective 30 days after posting unless you reject the changes by terminating your account.

Your continued use of the App after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, your sole remedy is to stop using the App and terminate your account.

19.3 Review Obligation

It is your responsibility to review these Terms periodically for updates. We recommend checking the "Last Updated" date at the top of this page.


20. Special Provisions for iOS Users

Since TravelTinder is distributed through the Apple App Store, the following provisions apply:

20.1 Acknowledgment

You acknowledge that:

  • These Terms are between you and TravelTinder only, not with Apple
  • Apple has no obligation to provide maintenance or support services
  • Apple is not responsible for the App or its content
  • In the event of any failure to conform to warranties, you may notify Apple for a refund (if applicable), and Apple has no other warranty obligation

20.2 Product Claims

We, not Apple, are responsible for addressing any claims relating to the App or your use of it, including:

  • Product liability claims
  • Claims that the App fails to conform to legal or regulatory requirements
  • Claims arising under consumer protection or similar legislation

20.3 Intellectual Property Claims

We, not Apple, are responsible for investigating, defending, settling, and discharging any third-party claim that the App infringes that third party's intellectual property rights.

20.4 Third-Party Terms

You must comply with applicable third-party terms when using the App (e.g., your wireless data service agreement).

20.5 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.


BY USING TRAVELTINDER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
